My school is trying to force me to give up social media passwords, but have not yet threatened punishment, but it is inevitable. Is this legal? I never used social media during school hours nor slandered the school nor used the school’s WiFi to do it, nor use a school computer.
This is a controversial and evolving area of law. Is it a violation of privacy? Is it a violation of constitutional law’s right to free speech and banning of illegal search and seizure? Are posts on social media disruptive to the school environment or bullying and warrant access? All tough questions. If you go to the Legal Research area of our site, type in “school demanding student social media password” and you will find several cases and laws that relate to this topic.
