Digital Millennium Copyright Act

Enacted in 1998, Title II of the Digital Millennium Copyright Act ("DMCA" - Full Text) limits the liability of certain internet service providers, for storing works at the direction of a user, that are protected by copyright. For the DMCA to apply, the provider must have taken certain steps including, among other things: Designating an agent to receive notifications of claimed infringement; providing contact information to the Copyright Office; and posting this information in a publicly accessible area of the provider's Web site. Although no official form has been published by the Copyright Office for designating (or amending the designation of) an agent to receive notifications of claimed infringement, providers should refer to 37 CFR §201.38 for guidance.
